  • Your ethnicity and other sensitive profile data require your explicit, affirmative consent before we collect or use them.
  • We use artificial intelligence (AI) to generate personalized prompts, content, and product recommendations based on your profile.
  • We do not sell your personal information to third parties. We share data only with service providers who help us operate the App and deliver our Services.
  • We collect information about children only indirectly, through the parent user, and the App is not directed at children under the age of 13.
  • You have rights over your data, including the right to access, correct, delete, and restrict processing of your personal information.
  • This Policy covers users globally. Additional rights and disclosures apply to users in California, Canada, the EEA, and the United Kingdom.

We collect different categories of information depending on how you use our Services.

2.1 Sensitive Data — Special Notice

Ethnicity and racial identity are special categories of personal data under applicable law, including the GDPR. We will request your explicit, separate, affirmative consent before collecting or processing this information. You may decline and still use all core features of the App.

2.2 Information We Collect Automatically

When you use the App or visit the Site, we automatically collect device identifiers, IP addresses, browser type, operating system, referring URLs, and information about how you navigate and interact with the App.

2.3 Information You Provide About Others (Children)

Our Services allow you to provide information about your children, such as their ages, dietary preferences, and school schedules, for the purpose of personalizing content for your family. We do not knowingly collect personal information directly from children under the age of 13. See Section 10 (Children's Privacy).

Section 3 — How We Use Your Information

  • Providing and Personalizing Our Services: To create and manage your account, deliver AI-generated prompts and recommendations, match you with relevant Mom Circle communities, and customize your experience.
  • AI-Powered Features: To generate personalized prompts, meal plans, home decor suggestions, holiday planning content, and other outputs tailored to your specific household and preferences. AI outputs are not a substitute for professional advice.
  • Offering and Delivering Digital Products: To present digital products relevant to your profile and purchase history, process your purchases, and deliver purchased items.
  • Community Features: To operate Mom Circle social features, enable connections between users in similar life stages or geographic areas, and maintain community standards through content moderation.
  • Communications: To send transactional emails, service updates, and — where you have given consent — marketing communications and promotional offers.
  • Safety and Security: To detect, prevent, and address fraud, unauthorized access, abuse, and other harmful activity.
  • Analytics and Improvement: To analyze usage patterns, diagnose technical issues, and improve the performance, features, and design of our App and Site.
  • Legal Compliance: To comply with applicable laws, respond to lawful requests from regulators or law enforcement, and enforce our Terms of Service.

Section 4 — Legal Bases for Processing (GDPR/EEA Users)

  • Contract Performance: Processing necessary to perform our contract with you.
  • Legitimate Interests: Processing necessary for our legitimate business interests, where those interests are not overridden by your rights.
  • Legal Obligation: Processing required to comply with applicable law or regulation.
  • Consent: Required for marketing communications, processing of special category data (including ethnicity), and non-essential cookies and tracking technologies.

Section 5 — Artificial Intelligence and Automated Processing

5.1 How We Use AI

The Promptly Mom App uses AI, including large language model technology provided by third-party AI providers (Anthropic, OpenAI, and Google), to generate personalized content based on your profile information, preferences, family details, and interaction history.

5.2 What AI Does Not Do

AI-generated content from Promptly Mom is for informational, organizational, and creative assistance purposes only. It is not a substitute for professional medical, nutritional, legal, financial, psychological, or parenting advice.

5.3 Your Rights Regarding Automated Processing

Where applicable under the GDPR or other law, you have the right not to be subject to a decision based solely on automated processing that produces significant legal effects. Our AI features are assistive in nature and do not make decisions with such effects.

5.4 AI Provider Disclosure

These providers process your prompts and interaction data as data processors acting on our behalf and are contractually prohibited from using your data for their own model training or independent purposes.

Section 6 — How We Share Your Information

We do not sell your personal information. We share information only as described below:

6.1 Service Providers

We engage third-party companies to perform services on our behalf, including cloud hosting, payment processing (Google Pay and Apple Pay), analytics, AI model providers, email delivery, customer support tools, and content moderation. These service providers are bound by confidentiality and data protection obligations.

6.2 Community Features

Certain information you contribute to Mom Circle — such as posts, comments, and profile display name — will be visible to other users. You control the scope of your public profile through your privacy settings.

6.3 Business Transfers

If Promptly Mom undergoes a merger, acquisition, or sale of substantially all of its assets, your personal information may be transferred as part of that transaction. We will notify you if such a transfer results in a material change to this Policy.

6.4 Legal Requirements

We may disclose your information to law enforcement, regulators, courts, or other government authorities if required to do so by applicable law or to protect the rights, property, or safety of Promptly Mom, our users, or the public.

Section 7 — Cookies and Tracking Technologies

We use cookies, pixel tags, web beacons, and similar tracking technologies on our Site and App. For complete details, see our Cookie Policy at www.promptlymom.com.

  • Essential Cookies: Necessary for the App and Site to function. Cannot be disabled.
  • Analytics Cookies: Help us understand how users interact with our Services. You may opt out.
  • Personalization Cookies: Enable us to remember your preferences and tailor your experience.
  • Marketing Cookies: Used to show you relevant promotional content. Require your consent in applicable jurisdictions.

Section 8 — Data Retention

  • Account Information: Retained for the life of your account plus 30 days following account deletion.
  • Transaction Records: Retained for 7 years to comply with tax and financial record-keeping obligations.
  • AI Interaction Data: Retained for up to 12 months, then anonymized or deleted.
  • Marketing Consent Records: Retained for 3 years following withdrawal of consent.
  • Sensitive Data (Ethnicity): Retained only for the duration of your active use of personalization features. Deleteable at any time through account settings.

Section 9 — Your Privacy Rights and Choices

To exercise any right, submit a request to admin@promptlymom.com or through your account settings. We will respond within 30–45 days.

Non-Discrimination You will not be discriminated against for exercising any of your privacy rights.

Section 10 — Children's Privacy

The Promptly Mom App and Site are intended for use by adults aged 18 and older. We do not knowingly collect personal information directly from children under the age of 13 (or 16 where required by applicable law, such as in certain EEA countries). If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us immediately at admin@promptlymom.com.

Section 11 — International Data Transfers

Promptly Mom is operated from the United States. For users in the EEA, Switzerland, and the United Kingdom, we transfer personal data internationally only under lawful transfer mechanisms, including Standard Contractual Clauses (SCCs) approved by the European Commission, adequacy decisions, or other mechanisms permitted under GDPR Chapter V.

Section 12 — U.S. State Privacy Rights

12.1 California (CPRA / CCPA)

California residents have additional rights including the right to know, delete, correct, opt out of sale or sharing, limit use of sensitive personal information, and non-discrimination. Promptly Mom does not sell personal information as defined under the CCPA. To exercise your California rights, submit a request to admin@promptlymom.com. Authorized agents may submit requests with written proof of authorization.

12.2 Other U.S. States

Residents of Colorado, Connecticut, Virginia, Texas, Montana, Oregon, and other states with comprehensive privacy laws have similar rights. We honor these rights regardless of which state you reside in. Contact admin@promptlymom.com to submit a request.

Section 13 — Canadian Users (PIPEDA / Law 25)

If you are located in Canada, your personal information is subject to PIPEDA and, where applicable, Quebec's Law 25 (Bill 64). We collect, use, and disclose your personal information only for the purposes identified in this Policy, with your knowledge and consent. You have the right to access your personal information and challenge its accuracy. Contact admin@promptlymom.com to exercise these rights.

Section 14 — Data Security

  • Data in transit is encrypted using industry-standard TLS (Transport Layer Security).
  • Sensitive data fields (such as passwords and payment information) are encrypted at rest.
  • Access to personal data is restricted to authorized personnel on a need-to-know basis.
  • We maintain an incident response plan and will notify affected users and relevant authorities of a data breach within the timeframes required by applicable law.

Section 15 — Changes to This Privacy Policy

When we make material changes, we will post the updated Policy with a revised Last Updated date, notify you by email to the address associated with your account, and/or display a prominent notice within the App.
